  • New York defines a limited-use motorcycle as having a top speed of 40 mph or less. Exceed any one of those and the vehicle is legally a motorcycle in New York — a different (usually higher) fee, and typically a motorcycle license, title, and insurance.
  • New York sorts mopeds into three classes by top speed: Class A (30–40 mph), Class B (20–30 mph), Class C (20 mph or less). Class A needs a motorcycle license; B and C accept any driver's license.
  • Insurance is required for Class A and B limited-use motorcycles; it is only recommended for Class C (rental fleets excepted).
